1-130 Processing times

You can use one I-130, I'm pretty sure.

Is your son also your spouses son, or no? If he's biologically your spouses son, then he won't need a petition, he's eligible for US citizenship and you can register his birth abroad with the US consulate and get him a US passport.

Hi there, No he's not my spouse's son. Would I then file two sepertate petitions in the same envelope with two sepertate pymnts or one check?

2 people, 2 petitions, 2 fees.

Go check out the guides and info at Visa JOurney, I'm quite certain there are others there who have already completed the process with children and would have more knowledge about it. I don't have kids, so I'm just going by memory from what I've read over there in passing.
