That is the relevant case, Reftel, but I'd get a lawyer to fill in the I-192 because there may be other relevant case law we aren't aware of that has a bearing on it. Reftel says the decision has to be rendered by an immigration judge, so given the length of the stay he's admitted to, CBP may want it reviewed by a judge - what was he doing for 18 months is going to be the point at issue, Reftel is merely about determining an overstay by a visitor, if he was doing something unauthorized, then that's a different issue.

And even if they do let him in that trip, doesn't mean they'll let him in on any subsequent trips. He will most likely be dragged into secondary every time he tries to visit the US now, or until he gets himself some sort of visa or waiver that allows easy entry.[/quote]

Usually it means a horrible room with metal chairs where you get to sit and wait for ages until they call you up to the desk and interrogate you.

I'd rather spend all day at the dentist's than sit in secondary inspection, frankly. At least the posters at the dentist's are moderately educational, in secondary inspection most of the posters simply go on at great length about all the things you cannot do:

"The importation of meat and vegetables is not allowed unless in one of the categories listed here:"

"You are not allowed to import more than $10,000 either in cash or currency instruments without declaring them."

"The importation of firearms and other weapons is prohibited without the correct permit from the State Dept. and/or ATF."

"Legal representation is specifically not allowed."

And then there is usually a heap of leaflets as well which tell you what you're not allowed to do as well. The most useful of which is the complaints form.
