5 months pregnant and seeking new TN

Post Mon Jun 14, 2010 6:02 am

Hello all!

I am currently working with TN statuts set to expire in July 2013. My job has become almost unbearable as of recently and I am considering a new job.

My issue is: I am currently 19 weeks pregnant. If I show up at the border requesting a new TN for a new job, am I going to be turned away for sure and also risk the TN I currently hold?

I know I can simpy hold on and wait til the baby arrives and then change jobs but my field is highly specialized and new jobs are scarce.

Thanks in advance!

Not being pregnant is not a condition for TN approval. If your sponsor is willing to hire you and you otherwise qualify, you should be granted TN. Period (or no period-- sorry  ).

Now, for your TN to still be good after your give birth, you need to stay on the rolls with that employer, ie, you can be on 'leave', otherwise you need a new status to stay in US.

So, if my new employer is willing to grant me a paid maternity leave then I should be fine since I would be employed through the leave and continue my job afterwards?

I think you can forget paid maternity leave, that is rare, never mind for a new employee in US. But unpaid leave is acceptable. Otherwise, you need to get a non-working status or move back to canada. That is the temporary nature of TN.
