A question regarding U.S spousal visa

Hi.

New to the forum so I apoligize if this is a redundant post.

My fiance and I want to get married and me move to the U.S. to be with him full-time. I understand the process of applying for a spousal visa, that's fairly understandable.

My question is, can I go visit him, get married in Tennessee (where he lives), I return home and then we apply for my spousal visa? I would remain in Canada working until we receive the approval. I'm just a little confused on that.

At VJ look at the k1 and CR-1 forum, once u figure the route u want to go. The above link has the + and - of each visa.

k1 takes around the 6-8 month time frame and the cr-1 takes anywhere from 9 months +.

Can you goto the USA and get married--YES, and then start the cr-1 visa--YES, thats what we did back in 2004.

Can 1 visit while ur visa application is ongoing? Simple answer is YES!! BUT it is up to the Port of entry (POE) officer! Ensure 1 has strong ties to Canada with them (return airfare, lease paperwork, utility bills, letter from employer expecting u back to work on such a date, etc etc

Everythign u need and more is on VJ!! Even a Canadian Forum! But u have to decide whats best for u, k1 or the CR-1. If u need to work right away, then the CR-1 is probably the best route! And since u can work right away--u can, if u qualify--collect Canadian Employment Insurance right away! With the k1, u can collect EI as well, BUT, not until you can legally work which isn't until you get your EAD document, and that can take around up to 3 months!!

Even examples of filled out forms on VJ (look at near the top of the page) Step by step instructions!! no need for a lawyer in 99% of cases. Ask all the free questions u want--and use the search engine! Best of luck

Have you thought about applying for the K visa from abroad, have it approved, enter the US and marry him within 90 days, then apply for adjustment of status/green card? The employment authorization doesn't take too long (probably a month after submitting petition) so you would be able to start legally within a couple of months of moving to the United States.

Yes pay Maxlaw to do it for u,lol OR read VJ and do it for FREE!! lawyers do not speed up the process, believe me. Most people can do it on their own. VJ has easy step by step instructions on how to do it! When it comes down to it---in most cases---the lawyer is just a $$$$ proof reader! You still have to collect all th einforamtion, paperwork, etc etc etc!!

Obviously Maxlawinc is spam as he could not spend 15 sec reading my post! The paperwork really is NOT that hard, its the waiting that is the killer and a lawyer does NOT have any special "ins" to make it faster, quite often they slow it up!
