About I-94

Hello. I have recently moved to New Jersey hoping to find new business opportunities with E-2 Visa. However, I have stumbled upon several difficulties that have given me hard times. Couple days ago, I went to DMV to switch my BC driver's license to NJ license. However, I could not even write the test because I did not have the I-94. But, this is truly odd as we Canadians do not need I-94. As a result, I was wondering if any of my fellow Canadians in NJ have experienced similar fate and I would truly appreciate if anyone could give me an advice to mend this problem.

If you have a visa, you should have filled out an I-94 when you arrived at the border. If you flew, you should have filled it out at the airport, and the POE agent would have put it into your passport alongside your visa. I'm guessing it is the same for an E2 as it is for any other visa, but I'm not even sure what an E2 is.

There is a form at the USCIS website called Application for Replacement/Initial Nonimmigrant Arrival-Departure Document and it is form I-102. The fee is $160. Go to the website, http://www.uscis.gov/portal/site/uscis then click on Immigration Forms, and scroll down.

New Jersey requires that you show proof of legal entry in order to get a driver's license, so without the I-94 for all they know you're an illegal.
