Adjustment of status, marriage in the USA.... help

Postby suzysuzy1985 » Sun Dec 02, 2007 1:05 am

Hey there everyone! I just have a question, I got married in ottawa canada august 10th 2007 to an american from West virginia. We are having our reception end of dec, and i was wondering if i was able to move back with him the end of dec and stay with him and apply for adjustment of status or however it is called. i am a canadian citizen and he is american, i am also 13 weeks pregnant. would i have to stay here untill i get some sorta visa like CR1 o anything like that, i am still holding to my marriage papers i havent sent them in to be registered in case it was easier for me to marry him in pittsburgh. my main concern is just not being able to be with my husband in the US especially with the baby on the way. thanx.

Since you're already married, and you got married in Canada and not the US, you're not eligible for adjustment of status. You'll have to stay there in Canada and wait out the CR1 or K3 process (both are taking about the same amount of time, and the CR1 is the better and less expensive process so might as well do that).

At least in Canada it won't cost you a few thousand dollars to have the baby.

Go have a look at http://www.visajourney.com/forums for information on marriage based immigration to the US.
