MD and VA won't recognize visa for in-state tuition. But in both case if you had your permanent address in their state for a year you can apply for in-state tuition, i.e you are considered resident of this state (nothing to do with federal tax residency, but it will impact your state tax residency)

I would have thought Maryland would have to, surely they must be aware of that Supreme Court case, it originated in Maryland.

The first question to answer is what non-immigrant category you're in.
