Advance Parole I131

It's been exactly a month since my biometrics and I have yet to hear from USCIS regarding my EAD and AP documents. I am in need to travel to Canada however in the next week or two.

I called USCIS and the person I spoke with said that he can take some info from me over the phone and submit it to the pertinent dept to expedite my I 131 processing. All that is required of me is a description of why I would incur a financial loss....(in my case, I own a legitimate business franchise and the manager of the business is quitting).

Any advice whether I should wait another week or so or should I submit my info over the phone and wait for a reply? The customer service agent mentioned that should immigration require additional info and any evidence, they will contact me within 5 business days.

I have heard many conflicting stories....what are your thoughts/experiences?

Make an INFOPASS appointment at your local office.

DO NOT leave the country without first having the AP document in your hands! They will not let you back in without it, and will consider your AOS application abandoned.

I don't think there's an option for me to chose that based on the list of options on the Infopass website....

What should I pick? THese are the options

Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

Case Processing Appointment - If you received a notice to go to your local office for further case processing.

EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

Well, I went to the Washington DC field office in Fairfax, VA on Wed and explained my situation..This morning, I checked the status online and it says that they have approved my I131 and that they have mailed out a notice of approval, but nothing about sending my actual travel document.

Yet they did say that my EAD card is in production.

Anyhow, when can I expect to receive my travel document then?

Hi there,

I just got my I131 document. In fact they sent me two similar documents. Do I need to both? Am I to surrender this document when I travel back to the US?

Are they both Advanced Parole documents?

You do not need to surrender them upon your return unless it has expired. You can use it again for subsequent travel if you need to before your green card is approved. Although, I wouldn't try to travel too often, unless absolutely necessary. They can deny your entry, even with the AP.

They were both AP documents... exactly the same. So kind of strange.

Anyways, I'm curious as to why you say that they can still deny me entry.

If so, then why am I getting the AP document.

I'm off to Toronto on Monday for one day and then back on Tuesday. And on Thursday I'm off to UK and Greece for over two weeks. And then most likely hop to Edmonton upon my return for a few days

Should I anticipate problems on the way back after each trip?

They can deny you entry because that's just what they do. If they have any suspicion that you do not in fact intend to settle in the US, then they can declare your AOS application abandoned and they can deny you entry. You get the AP document to make this less likely to happen, but it does not necessarily eliminate the possibility.

I guess it depends on the purpose of your trips, and the mood of CBP when you return.
