Hi everyone! I hope someone can answer my question. I am a cdn married 9 months ago to a US citizen. Have filed 1-130 and I-129F (K3) which and have been approved, waiting for consular interview. Problem could be that husband got laid off from his job 2 months ago, and is trying to start his own business but cannot show present employment or income needed for affidavit of support, however, I am in process of selling my business in Canada and will have significant amount of cash when sale closes. I also have more than adequate yearly amount of non taxable "income" in US funds from division of property from prior marriage/divorce and we own home/land free and clear. will this, with documentation, suffice?

If you have 5 times the required amount in CASH funds in the bank, it is possible to "sponsor" yourself.

Do either of you have children that are included and will be living with you and your husband? You have to factor everyone in the household into the income requirements.

For just a household of 2, the poverty guidelines say that the sponsor must have evidence of annual income of $17,112. If you are "self sponsoring" with cash and assets, you have to show evidece of 5 times that amount. If there are children, add in $4350 for each one.

Here's the document at USCIS http://www.uscis.gov/files/form/I-864P.pdf

If you have friends or family in the US who would be willing to co-sponsor you on the I-134 until your husband gets a job that's also a possibility. A co-sponsor can be any US citizen or legal permanent resident.
