Alien Fiance visa filing process (CAN-USA)

Post Sun Jan 08, 2012 9:04 am

Hello,
I'm writing on this blog cause after making some searches on our own, we were a little bit confused. I need to obtain more information on the Alien Fiance visa filing process and specially the work authorization which is the next step. My girlfriend, who’s a US citizen (living in Chicago, Illinois), and I (Mtl, Canada) have been doing the long distance thing for 18 months and we now want to be together for good. Therefore we are looking at filing the form I-129F, petition for Alien Fiancé, but before starting the process we would need greater clarity on the timing of receiving a valid work permit.

Thus far, from USCIS web site, we understood the following:
First step is to file the form of I-129F and wait for review of petition and file for the Alien Fiance visa. Once we are informed to be admissible, we can file form I-765 (Application for Employment authorization) which will provide me the eligibility to work in the US until we are officially married and have filed the I-485. But the timeline for each step and how I can find a job in the US prior to moving remains unclear. In addition, for greater details, although I have a MBA and am a CFA charteholder, I'm not eligible for TN Visa and I tried applying for job in hope to be sponsored for the H1-B and it's almost pointless. I'm currently working in Private Equity. My girlfriend is still a student and therefore we can't go through the form I-130 cause she can't sponsors me financially.

I wish to find a job in Chicago before moving to the USA. Can we apply for petition I-129F, once admissible, file the I-765 form to have a valid work permit increasing my chance to find an interesting job but then continue to live and work in Canada until I find a job or get married (the earliest of both) before I definitely move to the USA? Thus far we understand that as soon as file form I-765 for work permit, I would need to be moving to the US which means that I would have to quit my job and be jobless in the US.

Therefore, we would much appreciate to get greater clarity on which conditions the employment authorization (I-795) can be issued or valid. As anyone been through this and let us know what was the timeline for each milestones. We understand thus far that this is the fastest way of allowing me to finally be together but again, your help is more than welcome.

Thank you!

visajourney.com a free relationship visa forum! Thast 1 of the draw back sot the k1 fiance visa--1 cant work right away!! Tahst why some get married and go the CR-1 route!!

I do belive even if u go the k1 route, she still has to $$$$ sponsor ur! Thats why the USA citizen gets a family member quite often to co-sponsor you! Goto VJ and look over the k1 and cr-1 forums and READ thew guides at the top of each forum

http://www.visajourney.com/content/compare comparews the visas! k1 is "usually" the fastest but not always! And as u can see from that list 1 of the negatives is not beibng able to work! If u entered on a k1 and got married ASAP, it takes a few months to get the EAD (employment authorization document) but if u check VJ, u can get a more realistic time frame

Disregard the k3, gone the way of the dodo bird!! Cr-1 was taking a lot longer than the k1, but recently it has sped up a lot! But ya never know with immigration!

There is even a Canada forum,!
