I am a Canadian Citizen, who has been 'residing' in the US on a visitor visa for the last 5 months with my significant other who is an American Citizen. Due to some complications, my petition for a work visa has been declined. Instead of playing the boarder hoping game every 6 months, due to the fact that my significant other has a 'remote' job that involves a home office, we are presently considering moving our primary residence to Canada. My question is, what sort of paperwork etc would we we required to work with, that involves an American living in Canada, working remotely for an American company.
To give some background, we would have two residences, one American, and one Canadian. The american company, will still be billing/working under the assumption that she is American, but she will simply setup a 'dual home office'. She is an engineer, and travels regularly, and at least once a month will have a 24-72hr trip to the US, making the 'commute' back and forth inside 6 months a non-issue.
My question is, what is the best way to go about this? Should she 'hide' behind a visitor visa so as to side step taxation issues? Is there a visa that takes this situation into consideration? Is there something aside from lack of health insurance that would cause an issue? Is there anything I am missing or overlooking?
Any help would be appreciated, I have read through the forum, and everything seems to be based around a single residence. The intent is to marry, and then file for sponsor in the future, but in the meantime, what is the best option for us to explore in the short term (as in, less then one month before my visitor visa expires)?
