Any CONFIRMED case where re-entry refused due to overstay?

Post Sun Oct 21, 2007 10:54 pm

If a Canadian overstays in US without visa AND is known by the US border officer for some reason, will he be refused reentry next time? Is there a long period ban for reentry?

OR, even previous overstay is found, reentry still gets approved?

ANY CONFIRMED CASE FOR ANY ABOVE ONE?

I've read of several, mostly marriage based denials and bans. The ban can last as long as the border official says so. Either until you get a valid visa, 3 years, 5 years, or 10 years. I believe a life-time ban is only if you are inadmissable because of criminal record or admitted drug use.

You can appeal a decision, but the appeal process usually takes a long while. And they will have your information and profile at all border crossings, so just going to try another POE is not a good idea.

I was talking to a guy on the web the other day who lives in Abbottsford, he got banned from entry when he got pulled over for DUI in Washington, because he'd been living there nearly a year with a girlfriend. Reading between the lines I got the impression he probably had some weed in his car as well. Not sure how long the ban was for, but he said he hadn't been able to enter the US for years.

I am just guessing but i think the relatively low number of responses with confirmed "denied entry due to overstay" cases is also a derivative of the fact that most folks that got screwed so badly do not hang on boards anymore (no matter how good) but talk to their lawyers. I hope i am wrong. I wonder if the situation changed since the original post was made, and if so, how quickly those waivers were coming through...
