applying for a tier 2 general visa

Hi,

I've been working in the UK for the past two years under the Youth Mobility Scheme. I got hired to start a new job in the UK, which would start after my visa expired.

I came back to Canada, and the the company applied for a sponsorship for me, which they received. I then applied for a tier 2 general visa and was denied, because "I do not have a certificate of sponsorship issued by my sponsor" (everything else was fine). I'm still not really sure why it was denied, as I had a certificate of sponsorship number from my company and had attached a copy of an email the company received from the UKBA stating that the sponsorship was granted.

So I have some questions:

1. Is there specific documentation that the UKBA is looking for to prove this sponsorship? Something other than the email from the UKBA saying that it was granted?

2. Does the company need to do something to "issue" the certificate of sponsorship to me before I can use the number?

3. If I am able to fix this error, do I have to re-apply (pay the money again, get my fingerprints scanned etc)?

Any help would be greatly appreciated.

You may already be aware of these - if not do read

The other suggestion is to contact the visa folks & ask them what they're looking for.

You've said that you have the sponsorship certificate - I would go back too them again (nag them) & ask what more do you want

Otherwise, they're gettng picky & I can only imagine that the refusal (even though you havethe sponsorship certificate) is based on the fact that a UK resident can do the job which your prospective employer is offering you - or- that this job is not on the list of skilled jobs which cant be filled by a UK resident

Thanks for that. I have looked at the guidance notes before, and thought that I had everything for it. I'm wondering that maybe the company didn't specify that a Resident Labour Market Test had been completed on the Certificate of Sponsorship (even though they did one) and perhaps that was why it was denied. But again, I'm not sure.

I would love to get in contact with someone to ask them why it was denied, but I can't seem to find a phone number anywhere?! I handed my paperwork in the Toronto office, and it was sent to New York where the decision was made, and I can't find anyway of contacting them. Anyone ever done it before?

That could be it exactly.

suggestion - go to the Toronto office on Bay St & ask to speak to someone in the consular section [dont back off]. Take all your paperwork & explain the situation.

Having been there many times on citizenship & passports issues - they are generally very good & me thinks they can deal with your questions face-to-face
