Applying for Permanent Residency while under TD visa

Hi everyone,
I am a Canadian citizen who will relocate to the US in a few months under TN visa status. I currently work in China, and my wife is a Chinese citizen. I recently got my TN visa, and will be returning to China to apply for the TD for my wife, after which we will both move to the US.

My question is, can my wife apply for permanent residency while she is living in the states with me? I heard that you have to have plans to move to Canada in order to apply, and while we do plan to move there eventually, it would not be for a few years after I fulfill my role in my current job (2 to 3 years at least).

Also, is she free to travel into Canada without any China-Canada visitor's visa (After she has TD visa)?

I assume you are talking about Cdn permanent residency.

Typically, you (the Cdn spouse) need to be present in Canad during the porcess, so it may not be the time to do this (she could of course self-sponsor -- not thru marriage -- if she qualifies, which would not require her to move there until 3 years from approval).

But, when you do both decide to move to Canada, there should be no problem for her to get status at that time, so I wouldn't worry about it.

Until she gets Cdn status however, she will need whatever visa is required for chinese, as her TD does not confer any special Cdn entry status.
