Applying for Tier 1 General Migrant as a current UK student

Hi,

I am currently enrolled in a UK university & will not be awarded my degree until Jan 2010.

Since 2009 is a thesis writing up year, I would like to work full-time in the UK. With a student visa, you are only allowed to work part-time (up to 20 hours a week).

My previous earnings, degree, age, etc provides enough points for me to qualify for a Tier 1 General Migrant visa - in other words, I do not need to graduate from my UK university to have enough points to qualify right now.

My question is... Am I legally allowed to apply for a Tier 1 General Migrant Visa if I am currently on student visa status/have not graduated from my UK university?

I have recently got my Tier 1 General visa using this immigration consultancy.
