Applying for TN visa if I'm already in the US

Post Fri Nov 30, 2007 8:16 pm

I'm living in Hawaii and currently hold a TN visa which won't expire till next August. I'd like to pick up some extra part-time work, so I need to get a second TN. But I called the Port-of-Entry at the Honolulu International Airport and they told me they don't issue TN's there. I've been through quite a few websites in order to find out how to do it by mail, but I've only found information on renewing by mail. One website mentioned that you can get a visa issued at any port-of-entry or international airport, but offered no other information.

The guy I talked to at the POE suggested I call back tomorrow to talk to someone with more experience, maybe they can help me. I have a bad feeling this is going to turn into a typical visa nightmare (all my renewals have been nightmares, to some extent or another). If anyone has information or suggestions, please let me know. Thanks!

You can add a TN employer by filing a TN petition with USCIS. You can't begin working for the new employer until the petition is approved. The approval takes months, so you may need to premium process the petition.

Thank you very much for the reply. Is it form i129 that you're talking about? Because I thought that form was only for extensions of stay or change of status to TN from something else.

If I have to mail it in, that will pretty much kill the job offer. They want me to start now, and it's such a small job that I'd be done it in a few weeks (long before I got the authorization back from USCIS). And the pay would be a lot less than the cost for premium processing. Bummer.

Another suggestion:
If its feasible for you to fly to Canada (visit family, vacation) upon your return to the U.S. most Canadian Airports have a US Immigration where you will be able to apply for your TN Visa.

You will receive your TN Status immediately.
