On August 31, 2008 I was at the USA border, where a CBP asked me where I was going explained PA, asked me how long, I explained 4 months, got pulled over, then first denied entry, asked the CBP officier would i be able to go over still to visit family closer then PA, the CBP told me yes but wait a few days. September 3, 2008 I went to go back over and they banned me, I wanted to go visit a cousin for a week, they stated I was lying, and told me that I really was going to PA, so I then stated yes I was going to go to PA to visit family there, but cause I had no papers proving my job was here when i got back, no bank account statments, no credit card statements I got banned, can i have this reversed? By the way I have my fiancee in PA, as well I do have an aunt and uncle in PA, but when I went over to see him for the past 3 yrs I told CBP I was visiting family in PA, and I did visit them, but spent most of my time with my fiancee, so technically i didn't lie, and my fiancee is family as well, but they stated its not considered family. But in all can i have this reversed, cause were in the middle of getting my fiance visa, and if they see me being banned, they can reject it, any help will be much appreciated, thanks in advance!

oh and i have never been convicted in my life of any type of crime any where in the world, but felt like i was a murder on September 3, 2008 when they took my finger prints, and photo of my, first time since i was born i had finger prints done!

You cannot reverse being banned. When your interview comes up for your fiance visa application, you will likely also have to apply for a waiver, which may or may not be granted.

You may want to speak with an immigration lawyer about your options.

Your fiancee is not family until you're married, so you did in fact lie. Which is never a good idea, especially do not lie to US border officials, as they will eventually catch you at it and ban you. As is now evident.

And waivers dont happen over night! there is a few on Visajourney right now that i know of, and they take awhile, maybe a year or more! And that is on top of what it takes to get a k1 fiance visa interview (6-8 months)

thanks for all your replies, but even a waiver won't help me out, I do not have a criminal record, thanks for all your help, but I spoke with my finacee and he is willing to wait 5 yrs for me. To anyone else if your going to see your b/f or spouse if you get caught lieing i hope your young enough to wait 5-10 yrs cause thats what I am looking at.

banned_from_the USA, are you sure you weren't just denied? If not, did they tell you why you were banned? They have to tell you why. Aren't they supposed to give you papers saying why you've been banned? Did they say 5 years? Sounds strange. Are you from Canada? This is my version of he Spanish Inquisition. Smile

I honestly think this will be my last visit, as utterly painful as that is. It's too stressful for me.
