I wasn't going to reply. But I have to correct you on one thing, in case someone else comes here looking for this info.

If you are in my situation. Do NOT leave. Leaving, when you are out of status, will get you a 10 years ban.

You came on here looking for help. You could not face the truth. It's up to you. I feel real sorry for you as you are delusional in thinking your circumstances are simple. Don't come on here giving people bad advice. You will live in misery for the rest of your life running from the law. Good luck to you because you definitely need it.

Accually, I did research. Me being here pass the 6 allowed months (and married) means that I am out of status. Yes, it is illegal, however, that is what the AoS aims to correct.

As for Mexicans, as you mention, well, never mind the blatant racist bias, but yes, some do use AoS as well.

AOS probably won't happen in this situation due to the length of the overstay. If you'd applied back when you got married then a few weeks over six months wouldn't have been an issue - you entered with non-immigrant intent, you developed immigrant intent, you filed the paperwork. However you have now had immigrant intent for years, and knowingly overstayed. You need to talk to a lawyer, really.

You will be facing a lengthy ban if you leave and try and re-enter, I suspect the lawyer will suggest filing an I-192 and asking for a waiver, but that usually means leaving, and then you would apply for the waiver and also for an IR-1 visa at the same time which requires sponsorship by your spouse. This takes 7-8 months if you're lucky under normal circumstances, with a waiver application it will take longer and you may get turned down obviously.

Kittyfang, you don't sound all that scared to me. It sounds like you are very confident in your own research so it's not really clear what you came looking for on this board. The responders didn't tell you what you wanted to hear but perhaps that could just provide another avenue of research that you may want to explore? It all sounded rather feasible.

Let me know how AGNelson so i can forward this to my buddy. His wife came here on an F1visa he had a GC at the time all he had to do was to send his wife to school for 1 years and he would have applied for her legal paper he choose of course the easier way which was get married and have babies. Did i mention his wife was super HOT!!!!!!!!!

Well this was 9 years ago last he checked he was told by a lawyer to wait another year because some law might come into effect and if your illegal for 10 years you wouldn't have to go back something ( not sure).

PS did i add that he has 5 children the wife gained 200 pounds and is not super hot anymore or drive!!!!

The moral of the story follow the rules your spouse will just gain weight in the end and you will have a lot of babies don't create a headache for yourself in the future

I'm afraid you're in quite a pickle. The advice you've received so far from other sources is only about half true. It's the other half that is going to bite you in the butt.
