Ok here's our story...My common-law partner and I met via the computer back in february of 2003..She is a Canadian, I myself am American..She came to the U.S. in August of 2003..She was with me in the states for 2 years..She became pregnant and we came to Canada in August of 2005..We had originally just came for a visit but with all of her family here we decided to stay and have the baby..Now when we crossed the border coming to Canada I was only given a temporary resident visa for a month...I applied for an extension which I recieved a week ago..It was applied for under special circumstances..Her parents had to sponsor me since she was unable to work and was out of country for 2 years...I was told that I had to apply for permanent residency in order to work here in Canada..Well from what I've seen on other sites about that is that it can take up to 2 years to get that..That is much too long of a wait..Things are really getting tough here and we wish to return to the states..Now for my questions..
By the way our son was born January 13th...

1. Is there an easy way for her to apply to be able to stay in the U.S.??
2. Will it be easy for our son to obtain status in the U.S.?
3. Would it be possible to go to the U.S. embassy here in Canada and find out what our options are..?
4. What type of applications or forms do we need..?
5. Is there any hope..??

It shouldn't take 2 years to get permanent residency as the common-law partner of a Canadian national. It all depends on the service standards of the U.S.-based Canadian Immigration office. Here in the UK, it says 30% of the applications under the Family-class are process within 3 months (after the person has been approved as a sponsor, which takes about 39 days).

Look on the CIC website under the Family Class sponsorship. The government says they are committed to uniting families, and they certainly place high priority on sponsored cases as opposed to simple work-based immigration.

Thanks a bunch Susie D....I have been to the CIC website but things just seemed so complicated since I really didn't know what to look for..Our only problem we will have to see about now was the fact that my common-law partner was told at immigration here in Ottawa, that she couldn't sponsor me since being away in the states for 2 years..HMMMMM this could be a tough one..Well I'm off to look at the website again and see if maybe I can jump in a little further..Thank you so much for your reply and info..Have a fine day :D

Even if your partner were to sponsor you, part of the sponsorship requires that she sign an agreement that she will provide for you for 10 years so that you would not be a "burden" to the country. Wether she would have to prove that she can, I'm not sure.
That's what I would have had to do if I were to attempt to get papers for my Mexican ex-wife.
And to get actual residency papers takes something like up to 2 to 5 years. Go to the nearest Canadian Consulate or Embassy in your area and inform yourself better.
