Can husband visit U.S.?

Hello -

I'm a U.S. citizen living in the U.S., and my husband is Canadian and remains in Canada. We'll be married for 6 years in July. I lived in Canada as a permanent resident for 6 years and recently moved back to the U.S. when my husband and I decided to separate (not divorce at this time). I wanted to be closer to my family here in the U.S.

We're still in the process of trying to see if maybe we can make our marriage work. Will it be difficult for my husband to come visit me in the United States since we're still married and trying to see if we can work things out? Also, what if we decide to try things out with him living in the U.S.? Would I be able to file paperwork for him while he is still in the country?

He shouldn't have problems visiting if he has evidence of ties to Canada, like a job and mortgage or rent payments etc etc etc.

As for him moving to the US, you can apply in Canada at whichever US consulate is closest to your Canadian home, as technically you are still a Canadian PR. It'll take about 3 to 6 months to process the paperwork. I wouldn't advise for him to attempt to move first, and then apply for adjustment. Paperwork first, then move.

As a Canadian citizen I believe you can visit the USA for 6 months without a visa. Double checking this would not hurt of course =)

yes, a Canadian can visit the US for up to 6 months, but during that time you can't legally work or do much of anything to contribute to the upkeep of the home, so for some couples, this isn't always an option.

Again, I'd suggest the DCF option for petitioning for an immigrant visa at the closest US consulate to your address in Canada.
