Can I obtain a TN visa with a pregnant wife?

Post Thu Jan 12, 2012 3:00 pm

Hi everyone,

Sorry if this has been answered, but I couldn't find a specific thread that covered my situation.

I am currently in talks to land my dream job with Walt Disney animation studios and would be obtaining a TN visa to work down in the states. I am married and have a 3 year old daughter and a wife that is currently 2 months pregnant.

Can my wife have the baby in the states without risking my work permit? Do we need to disclose the pregnancy at the border?

I haven't been given information on health insurance with my new position yet, needless to say, if my family isn't covered we will be staying in Canada to deliver the baby. But I would hate to miss out on this once in a lifetime opportunity.

Funny. You will do well at disney with that sense of humour.

Seriously, OF COURSE you can get TN if otherwise eligible. I don't know what category you would be applying under; you seem to have that under control.

The gestation status of your spouse is of no concern to immigration, nor the company.

It is not illegal for foreigners to have a baby in US, regardless of your immigration status. Nothing is gained for you by having child born in US. Even though it will be a US citizen (and Cdn), the child acannot sponsor you until 21 yrs old.

Both the pregancy and birth expenses will be covered by your insurance. Disney will give you the details of when coverage kicks in, etc.
