Can I reclaim my citizenship?

Post Mon Oct 10, 2011 2:10 pm

My great-grandfather was Canadian Cree. At 47 he became a citizen of the US. I have his papers. My grandmother, as the youngest of his 11 kids, was 4 when they moved to the States. I would very much like to repatriate to Canada. But since it was my great grandfather who did the paperwork, is it even possible?
Can anyone help me with this question? Is it too many generations back, even with my grandmother being born in Canada? Both are deceased at this point as is my father who was the next in that line.
Any help would be greatly appreciated.

Your parents have to have been Canadian citizens. There was a provision in place before that would have allowed 2nd/3rd generation Canadian descendents to claim citizenship under certain conditions, but that law changed in 2009. Now you can only claim citizenship if your parents were citizens here. I don't think there are any special exceptions granted based on native ancestry.

Thanks. Yah, I am way too diluted at this point to really claim my dad's native ancestry. I'm only half. I was more hoping that since my grandmother was Canadian, I could reclaim that way. Oh well..
Thanks for the reply :)

You aren't eligible for Cdn citizenship based on the ancestry you describe, HOWEVER, there are of course special "immigration" rights under the Jay Treaty which may allow you free movement into canada, depending on blood, etc.

Just to clarify sour's response, for you to be a Cdn citizen if born outside canada, at least one of your parents would have to be Cdn citizens, born or adopted in canada, or naturalized, not also born outside canada. canada allows transmission of citizenship to one generation born outside canada.

Once in canada for the requisite time you could apply for naturalization.

Thanks! I'll look up the Jay Treaty. My dad was born in Michigan so no go on his citizenship. There are no recognized Cree tribal areas in the States so he spent most of his life on the Mojave rez in Arizona. Aside from visiting him there, I have had very limited connections to his ancestry. Took it upon myself to study what I could find about his background but info is so limited here.
Darn my grandad! Hate that he decided to leave! :)
