can i work there?

Post Sun Jul 25, 2010 11:10 am

Hello everyone. This is probably going to be construed as a dumb, n00bish question, but I do just want to make sure I am understanding this properly.

I am 26, a manager at a Starbucks, and have a degree in English from an accredited university here in Canada. There is a not-for-profit managerial position in the United States (Utah, specifically) that I would like to apply to. My dream job, in fact.

Because this position is not on the NAFTA job list, and because it would appear I do not have a degree listed on that list, am I to understand correctly that there is no way I can work in the United States? Ever? Or, if I did get the position, would I be able to apply for a one year TN visa?

If someone would please enlighten me, I would SO appreciate it, because as it stands it would APPEAR that I am not qualified to work in the US, but I'm hoping I am mistaken.

Thank you, merci,

Jane

The NAFTA job list only applies to a TN visa so just because that doesn't seem to fit don't count yourself out yet.

Depending on the details, you might qualify for another type of Visa. I'd talk to an immigration lawyer (or a couple) and get their thoughts.

Personally, I think the details of your job in Utah are more important or rather, what they are willing to say your job is.

Zooch, first of all thank you so much for replying. Your info made my day! Honestly I didn't even think there was another avenue to take besides the TN - so thanks for enlightening me!

Would you or anybody on here know off hand what else I am allowed to apply to? What kind of work visa? Also, is a lawyer the only way to go? I'm just not sure I could afford a lawyer's time, to be honest.

Thanks!

A lot of immigration lawyers offer free consultations, either in person or on the phone. Track some down and see what they have to say, gratis.
