Can you get a settlement visa while in the UK?

Post Fri Dec 18, 2009 5:52 pm

Hi There,

I am hoping some folks with experience can help me out.

Me (British Citizen) and my spouse (Mexican) currently live in Toronto and we were considering relocating to the UK. My question is, can we go to the UK and while we are there, can my spouse apply for the settlement visa at the local visa office in Glasgow?

We have tried to call the british visa office and they are saying no, because you cant go from a holiday visa to a settlement visa. But my spouse doesnt need a visa to enter and stay in the UK as a visitor or on vacation. We were there in May for a vacation.

We were hoping to leave in January to go to the UK and dont want to apply for the visa here in Canada. I recently renewed my british passport from Canada. I had to send all my stuff to a visa processing centre in Washington USA. Then they lost my passport. Took them 3 months to get me a new british passport. I wasnt happy and spent alot of money calling there $2 per minute line to bitch and complain.

So the long and the short, can we take off for the uk and just apply for the settlement visa in Glasgow? We already have a house etc there.

Thanks

Well the answer is "No". I have had family members talk to UK immigration from inside the UK. Unfortunately, you cant apply from the inside.

You can apply from inside Canada.

HI THERE,

I WAS LOOKING FOR SOME ADVICE REGARDING OUR RECENT APPLICATION; WE HAVE RECENTLY RECEIVED AN EMAIL FROM THE UK EMBASSY ASKING US TO SUPPLY SOME ADDITIONAL DOCUMENTS.

ONE OF THE THINGS THEY HAVE ASKED FOR IS 3 MONTHS BANK STATEMENTS THAT IS NOT A PROBLEM TO SUPPLY HOWEVER THE ISSUE I HAVE IS THAT MY STATEMENTS DO NOT SHOW A SUNIFICANT AMOUNT OF FUNDS IN MY ACCOUNTS, AS WE GOT MARRIED 6/2/2010 AND THE SAVING I HAD WENT TOWARDS OUR WEDDING IN LIMA, PLANE TICKETS AND THE VISA APPLICATION SO I HAVE ATTACHED A NOTE TO THE UK EMBASSY EXPLAINING THIS.

BUT I WAS WONDERING IF ANYONE KNOWS IF THIS HAS DETRAMENTAL AFFECT TO OUR VISA APPLICATION?

KIND REGARDS
