Canadian Aboriginal w/a Non-Native Spouse

Post Sun Feb 28, 2010 3:19 pm

I am a Canadian Aboriginal. I know that my ability to work and live in the US is covered under the Jay Treaty. My husband is Canadian and would obviously not fall under this. There are many opportunities for work in his field (Telecommunications) in the US and we are considering a move there. We are currently in Bermuda, but would like a change. How long would this process take and how would we go about starting this process as I can imagine, it would be quite lengthy. Any feedback would be appreciated. Thanks!!

Hello all,

What general documents are requested at the border to apply for a green card via the Jay Treaty? Would my status card, and letter from an attorney swearing 50 % blood quantum suffice? Please advise.

Hi there. I think you would have to actually obtain a blood quantum from your local band office. I know six nations has the forms available for download at their website. I think its about 15 dollars to process. Probably alot more economical to go that route rather than having to pay a lawyer. Hope this helps! Cheers
