canadian / american baby

i am canadian live here always have . . my fiance is american . . alwyas has been . . i have a 14 year old going throu brain issues as he has a rare large tumor . . we are also haven a baby due in just over 10 weeks . my fiance wants his daughter to be american cause e cant afford to pay for 3 visa etc . . . so do i have to have her there or will she have rights with daddy being american ???? HELPPP

Don't try to have the baby in the USA. For one, I doubt we will let you visit your fiance while 8 mos pregnant. Second, the baby will derive US citizenship through his/her father. And third, your better off having the baby in Canada with the health care system. Steven would know the proper paperwork needed through USCIS.

If you have the baby in Canada, just go to the closest US consulate after it's born and register birth abroad. He/she will be a US citizen, and will be able to get a US passport.

Yeah, have a look at http://www.consular.canada.usembassy.go ... abroad.asp it's all on there. The baby derives US citizenship through the father, better to be born in Canada from the sound of your circumstances. Because you've got the problem in reverse if the baby is born in the US.

How does this work if it was the opposite? I'm a Canadian citizen and my husband is American and if our baby was born in the States would we be able to go to a Canadian embassy and register birth abroad so the baby could get a Cdn passport?

No. You do not register the birth. You apply directly for his citizenship card thru citizenship canada and he is a citizen.

US doesn't have a "citizenship card" thus the ability to register birth provides proof od US citizenship for later use.
