Canadian Citizen wants to divorce a American Citizen

Hello, I am a Canadian Citizen who got married to a American Citizen in the Usa in 2003 without the proper paper work, I have been back in Canada for over a year now and he has been living with someone else. I have had no contact with him and do not even know where he is. We have no children together. I know I can not go back to the Usa since I was there illegally so I am wondering if I could divorce him here in Canada? If anyone has any information it would be very helpfull. I have tried to find him to get him to file for the divorce but have been told by his grandmother he said he would never file divorce papers. I am lost and need help.

Sure you can go back to the US, you did leave, and you don't intend to stay illegally again do you? But yes, you can likely file for divorce from Canada but considering the situation you will most definitely need to get two lawyers, one in the US and one in Canada. Cost-wise, you may just want to do it from the US. Make a quick trip down, find a lawyer, have the lawyer find your husband and then serve him with the papers.
