Canadian claiming taxes paid in Vegas

Hi there. I just found this forum and it looks awesome. I'm pretty sure this is a dumb question but I thought I'd ask it anyway.....my father in law went to Vegas in November 2008 and luckily won $2,500. on a slot machine - $750.00 in taxes were taken off the top. Soon after he got back home to BC, I started doing the homework and found out how to get the money back. It took awhile - we had to apply for an ITIN, send a notorized copy of his passport, fill in the 1040NR form and wait and wait and wait....but finally, we got the cheque in the mail around June/09. Anyway, he just went back to Vegas in April/10 and lo and behold, won another $2,500.00 so we want to claim to get the taxes back again. Of course we already have his ITIN so it's only a matter of filling in the 1040NR form. Here's my question.......do we have to wait until January 2011 to claim for the taxes that he paid in 2010? I thought I'd apply for it right away as he won't be back to Vegas again this year but I'm wondering if I can? The forms online are only for the 2009 taxation year. I think I might have answered my own question - I guess I have to wait until Jan/11 to file form 1040NR.....am I correct? Thanks for all your help!

Yes you have to wait until the 2010 1040NR is available -- and the end of the current tax year.

Just for info: the way to get tax back is by tracking and claiming one's gambling losses against one's winnings.
