Canadian Common-Law Visa Options (TN/F1 or M1)

Post Sun May 01, 2011 8:26 pm

Hi all,
I am a Canadian and have just taken a job in the US on a TN visa. My common law spouse (also Canadian) is coming with me. He is planning on going to school, but for a technical program. Is a F-1 or M-1 visa the best option for him and is he eligible for one if it is not a bachelor program? And with a technical (likely 2 year degree) will he be able to get a work visa when he graduates? Is he eligible for a TD visa if we are common law, and can he go to school with that visa?

He is not eligible for TD status. Unless he goes to school, he can only entrer on B2 visitor status, maintaining a full-fledged home outside US all the while.

The school he wishes to attend can help him determine which status he needs.

Thank you for the information. Is it possible to get a work visa with a technical 2 year degree?

Possibly a TN.
But, only if there is an additional 3 years of related experience, AND (most importantly) the job is one of the TN-listed professions. See a TN-savvy website like grasmick.com for more info on this.

Otherwise, no.

So there is no way without a 4 year degree that a company could sponsor him for a visa? Could it be done with a green card sponsorship? I have friends from other countries living in Canada who work as landscapers or other jobs that don't require a degree because the company sponsors them. Is there nothing similar in the US?

Immigration to US is not immigration to Canada.

Besides, what did I just say? diploma and experience can get you in under TN for some jobs.
