Okay I'm super confused. I'll try to be short.
I have been travelling to u.s to set up a real estate investment company. I have talked to immigration lawyers and I know I will need an E-visa. In order to be eligible for an E-visa, the investor needs to invest a significant amount in the company. So a lot of lawyers suggest putting the money in escrow or purchasing the property first then apply the visa. So that's our plan - set up an LLC then put the property in the LLC then apply for visa.
Since we will need a car to get around in Phoenix, we wanted to bring our car with us. Shipping the car costs us $650 while renting a car for two weeks is more than $700. We planned to bring the car to Phoenix for less than 1 year then bringing it back to Canada.
I called the custom in advance asking if I bring my car with me to the u.s for less than 1 year to set up the company, will I need to import the car. The agent who answered the phone said "no you don't need to import it"
Today I arrange a truck to pick up my car. When I got to the border, the agent asked me to go in, and denied my entry. He said I can't import my car because I don't have a visa. He also said setting up a company I don't use a B1, I need an E-visa. He said I'm jumping ahead. And he said I don't have enough money to invest and I'm not ready.
I don't understand what he's trying to say because what they said seem to be contrary to what I've read. I wonder if any one can help me to understand my situation and whether what he said is true.
1. I've read that during the process of setting up the company, without money committed to purchasing a business in US, I will not be eligible for an E-visa. But the agent said I need an E-visa to set up my company?? I don't understand how is it possible for me to get an E-visa while all I do is going there meeting with people who will show me to places and show me the material to use in construction.
2. Why am I not allowed to bring my car with me? It's for less than 1 year use.
3. This is quite ridiculous. He has never asked me how much money I have to invest, but he said "you don't have enough money to invest". The person who is mentoring me is quite experienced in the industry, and he said "the amount is adequate".
I wonder if I'm missing something or is the agent just being difficult? I told the agent I consulted an immigration lawyer and he said we need an E-visa when we blah blah blah, then the border agent answered "good for him, but I don't care".
I wonder if his decision is an ultimatum and that he has the right to do that or can I appeal his decision? Is there a place I can call and get more accurate answer instead of talking to lawyer and then the custom can just say they don't care and their decision is final. Is there a number I can call to understand the reason of my denied entry?
