Canadian from Spain to US

Hello everyone,

I am a canadian/spanish citizen currently living in Spain, my spanish company may offer me to work in his office in US as a canadian and I would like to know if i can get the TN visa with no problem.

My residential ties (family, current job, house...) are with Spain and I don't know if that is appropiate to prove temporary intent.

Another question is: Can I fly directly to a US airport from Spain and present all the TN visa documentation or do I have to go through Canada first?

You may confuse them by having a Spanish address...any chance your have family in Canada you can list as your permanent address? Probably would limit that line of questioning if you did. They will still ask why you are coming from Spain though.

As far as airports, any major one should be able to process the TN...just a matter of how familiar they are. Although there are pros and cons of both, I think it's more likely you'll get through with small problems (say, the wording of the letter isn't quite right) if you are dealing with someone who sees TN's all the time. Of course the same person may be better able to identify such issues and bounce you because of it if he/she is having a bad day.

Best bet may be to get a flight that connects through a Canadian airport. Just make sure the connecting flight goes through the pre-flight inspections rather than the international terminal (where you won't go through customs until you get to your destination...this can happen if it's a very early or very late flight).

You should be fine as far as proving temporary intent.

You can get a TN at any Class A port of entry, which includes all international airports in the US. Some airports don't seem to know as much about TNs as others. The New York area airports know about them (JFK, Newark) but I've read posts from people that have had problems at other airports like SFO or LAX. You might want to call the airport ahead of time to make sure there will be somewhere there to process your TN when you arrive.

Another advantage of going through a Canadian airport is that you don't necessarily have to mention you just came from Spain, so long as you have a Canadian address you can use.

CBP at any US international airport can process TN-1 applications. Doesn't matter where you reside, the law says the stay has to be "temporary" which is a bit vague really, having an abode abroad can help with that but it's not absolutely necessary and it doesn't matter where it is, having a definite end date in the job offer letter and some sort of indication you plan to leave is more important. The key point is that you must be a Canadian citizen to apply. If you have dependents who are not Canadian, they will need TD visas.

Some people say coming in via Canada is better because they're more familiar with TN-1 applications, but that is a double-edged sword really. Being more familiar with them means a marginal application could be more likely to be rejected. If it's a fairly straightforward application you might be better off coming in through Canada but it's subjective.
