Canadian in NYC hoping to renew TN for 3 years

Post Tue Jan 25, 2011 6:48 am

Hi there!

I've been renewing my tn visa here in NYC since I arrived in June 2007. I did a 3-month, then 2 6-month, then 2 1-year.

Until the most recent renewal I would do the interview at the airport, which I found very stressful, so last year I used an attorney to mail in the extension. It turned out to be even more stressful plus expensive!

This year I've decided to renew on my own, going across the land border from Toronto to Buffalo.

It's my first time doing a 3-year extension and I was wondering what new things I might need to consider in preparing. Does the employer offer have to outline my work for the next 3 years?

I'm doing this one myself so any info would be much appreciated!

my visa expires start of March and I plan to renew mid Feb.

thanks!
Steve

Yes, the letter should at least say your services will be required for some period of time, or it will be denied. The letter always has to have a work duration, upto 3 years.

Aside from a general declaration that i'm needed for 3 years, do you need to offer specific evidence that you're working throughout the full 3 years?

It would be impossible to provide "evidence" of future events. There should simply be a statement that you will be performing XX dutues (which should accurately describe duties of the TN category under which you are applying) a that they are currently expectin gto employ you for 3 years. They simply state 3 years. If they don't want you anymore, they lay you off and your TN at that moment.

It is very unusual to have had to get so many short-term TNs for the same firm, since 3-year TN has been avaialble all along, you should only be on your second 3-year TN by now. There was never any need to be overly-precise on how long they were going to hire you, espeically since it looks like they prediction skills aren't very good anyways.
