Canadian in the US -- filing 2009 income taxes

Post Mon Jan 25, 2010 12:34 am

Hi everyone,
I've found this forum extremely helpful when navigating through the whole TN visa process last year. I've been living/working in California since July 2009 (on TN visa) and am trying to figure out what the process is regarding filing income taxes for 2009. I'm totally confused by all the information that's out there and would really appreciate any advice / links / step-by-step guide to figuring this out.

Some info (1): I have contributed a bit to my RRSP in Canada and a 401(k) plan here but still have room to contribute to my RRSP. How do I figure out how much more to add to my RRSP to get the maximum benefit?

Some info (2): I have done some basic calculation and I do meet the substantial presence test. However, I read there is still a possibility that I could be considered a nonresident alien in the US -- how do I figure this out?

What do I need to submit in each country? Is there a specific order in completing/submitting the forms (i.e., info from one to be used in another)?

Thank you!!!

I moved and started working and being paid in US funds by a US employer in Oct 2008. Ifiled 2008 Canadian taxes and claimed my US wideworld income in Canada. I maxed out my RRSP contribution in 2008, because there is not a RRSP advantage when you claim it against your worldwide income if you do not have Canadian income. In the US I filed as a non-resident on a workvisa and was fine doing both for 2008. I have since applied for and have been granted non-resident status in Canada. Its worth it to talk to a tax accountant for an hour, they usually give you an hour free for their advice. Hope this helps.

Only employer-sponsored plan contributions are deductible, not personal plans.

They would be removed from your Cdn wage amount that you report on 1040.
