Canadian investment rules for nonresidents

Post Mon Aug 31, 2009 8:00 am

I am a nonresident of Canada for CRA purposes. I retired and lived in the US for some years and still file income tax returns in the US although I now live in Mexico - still retired. I have US investments I would like to move to Canada. Can I hold and trade US equities and mutual funds in Canada, while I am a nonresident living in Mexico?

You can hold US equities thru a Cdn broker. But US mutual funds are off-limits for Cdn residents for two reasons: No one in canada is licensed to sell you those funds, and no on in US is permitted to deal with Cdn residents outside of a retiremnt fund.

You can hold the ones you have until you want to sell them, but likley the US broker will be wanting to off-load you as a client for fear of regulatory violations.

But he's not a Canadian resident - I assume you'd have to use a Mexican broker. Are you a US citizen?
Steve.

Good catch steven. Generally Cdn securities laws would allow a former Cdn resident moving to mexico with a pre-existing relationship with a Cdn broker to maintain their account. Setting up a new one would be problematic.

In any event, mutual funds would be out of question.
