canadian, living in cali wanting to marry

Post Thu Jan 15, 2009 2:29 am

hi there

i am a 22 year old girl who is a canadian citizen. i met my boyfriend 3 years ago and we have been going back and forth visiting each other ever since. this time i have been here since Halloween, and we have decided that we want to get married.

i want to know what the steps are in order for this to happen and how much it is going to cost. since i am already here i do not want to leave the country.

and i was also wondering once after we have married how soon will i be able to work?

thanks so much everyone

Check out the forums at Visa Journey ALL the information you need will be in the Adjustment of Status forum and Guides.

Adjustment of Status fee is $1010, includes adjustment application, employment authorization application, and advance parole application. EAD is usually processed within 90 days of when they receive your app.

If you genuinely entered with "non-immigrant intent", i.e. you weren't planning on staying permanently when you entered and you decided to get married after that, then basically all you need to do is get married and apply for AOS using I-485 and the other related forms (I-765 etc. it's all listed on visajourney).

You are only allowed to remain in the US for up to six months as a regular B-2 visitor, so you need to get the ball rolling.

The instructions for I-485 are very complex, read them carefully. Your boyfriend needs to be able to show he can support you (125% of the poverty rate) on I-864.

This is usually not a problem, but what is a problem sometimes is that they want to see three years of tax returns, so your boyfriend needs to be up-to-date with his taxes.
Steve.
