Canadian married American in US, what next?

Post Thu Jan 29, 2009 11:12 am

I live in the US and married my Canadian girl friend of over 4 years. We got married in the US. We are about to file the papers ourselves without an attorney to save money. We both live in the US and she has a daughter. What papers do I file now so she gets residency, a green card, is able to work in the US, and travel to Canada? I have gone to the USA immigration site, but want to be sure I do this right.

Thanks,

There are lots of threads on here that cover this topic, have a look through them.

You say she's been your girlfriend for four years? When did she enter the US? If she overstayed visitor status (or any other status) she cannot adjust status because she's in the US illegally, she'd have to get a waiver. Or leave and you sponsor her on I-130, but that will be difficult because she won't be able to explain the last four years.

Also have a look at www.visajourney.com

She was my girlfriend while she lived in Canada and visited every weekend in the US at my place. We got married in the US in December.
