canadian married to american thinking of moving to usa

I am married to a us citizen who moved to Canada after we got married and is now a permanent resident of Canada but still crosses daily to work in the US. We are now thinking of moving to the US and for me to get a job there, if i'm not allowed to cross as she does to go to work everyday. Once we submit the Spouse Visa am I allowed to continue to work in Canada? If not when will I be allowed to find a job in the US. Also are their any restrictions on crossing back and forth to visit our families while the approval process is underway? Also someone mentioned a CR1 being better than a K3, is that true?

Since he is a Permanent resident of Canada as well, you have the option of DCF. Check out the DCFforum at Visajourney, can explain it better than I. BUT keep in mind, its the fastest option of the marriage based viasa, but its not exactly speedy!!

1 Problem your going to run into,, is that the Montreal consulate (where the interview will be for any CR-1/IR-1,) wants the Amrican to already have established residence in the USA. Does it make sense, not really!

Once you submit the visa application, yes you can continue to work in Canada, you can't "move" to the USA until you have the actual visa in your Canadian Passport. And if you live close to the Border once ur living in the USA, you could go back daily to work in Canada, I know a few that do that, 1 is even a Cdn border guard.

You CAN visit the USA while the process is ongoing, BUT (big but,lol) its all up to the Port of entry (POE) official! Ensure you have ties to Canada( mortgage, utility bills, letter from employer) Something that gives the POE officer a comfy feeling you will be returning. Many do visit with no problems, but every now and then someone has a bad experience. Maybe they used a wrong word--ie to LIVE inthe USA, when 1 should use the word "visit" Thats like the #1 question in the CDn forum over at VJ!

Read over the DCF forum, may give you a timeline, not sure how long its taking for DCF, was around 4-6 months, sometimes longer, sometime shorter. The Normal Cr-1/IR-1 is probably closer to a year!! DCF just means Direct Consular Filing, your still going for a CR-1 or IR-1 visa. CR-1 is married for less than 2 yrs, thus a 2 yr greencard and the IR-1 is married 2 yrs or more and you get a 10 yr greencard!! DCG one just gets to sort of skip a few steps that speeds up the process. But you will find out, Montreal and the word speedy, do not go hand in hand! K3 has pretty much gone the way of the DoDo bird.

You will read where the have gone to the interview but NOT approved, not really denied, but they waited for the USA spouse to go back to the USA and establish residence in the USA, then send in evidence that they had!! And you you find that Mtl is not fast at looking at that new evidence and then issuing the visa! I mean they slow!!! You will read how people have handled that! Maybe things have changed, I havent really kept track of that. cheers
