Canadian married to an American......

Post Mon Jan 19, 2009 12:33 pm

I am a Canadian who recently married an American. I came down originally in 2004 on a J1 work visa. Fell in love with my current husband and for years I came back and forth, making sure to never extend the 180 limit.

Since I last entered the country (sept 08), we married and have filed papers for me to live/work here and to travel back to Canada for visits. I hope to get results in the next 4 months.

Anyway, we have considered growing our family in Canada, rather than the US--- does anyone here know where to start with that? Is it possible to get my husband documented for life in Canad while we're both in the USA?

Thanks!

Hello and congrats!

Here is a great resource site for you to peruse with all sorts of links to the forms needed to sponsor your husband. The online community is a great resource and support, happy reading!

He can't be "documented for life" while he's in the US no. He'd have to first get legal permanent resident status in Canada, and then live there for 3 years before he'd be eligible for citizenship.

Same as you in the US, after you get your green card, you will be eligible to apply for citizenship after 3 years of living in the US. But if you move to Canada before you're eligible to apply for naturalization, you forfeit your green card, and your opportunity at US citizenship.

The immigration process for the US and Canada if you're already married is basically the same, pretty much. The differences are minor.

The mistake people make is that they decide to live in one country and then a year or two later decide to move to the other but still want the option of living in the first country. This is a mistake because it's hard to maintain LPR status if you leave and if claim permanent residence you have to pay taxes there.

If this is the sort of situation you're thinking about, wait until you have citizenship in the first country you moved to before you think about moving to the other one.
Steve.
