Canadian married to US citizen wants to return to Canada

Hi Everyone,

I am a Canadian citizen and I live in the US. I have been married to a US citizen for almost 6 years. Due to my husbands health and financial situation, we have not filed for my green card in that time period. Now I would like to return to Canada to visit my family and I am wondering if I am able to do that without a green card and if I will be able to return to the US?

If I do go to Canada, will I face the 10 year ban and not be able to return and be with my husband?

Any advice would be so helpful!!! I am wanting to visit my family ASAP.

So basically you've been in the US illegally for 6 years?

Yes, you will face a ban of up to 10 years, possibly life, if you leave the US now.

I suggest you seek a consultation with a competent immigration lawyer in the US, and decide whether you want to stay in the US and apply for adjustment of status (which could likely be denied at this point) or return to Canada, and sponsor your husband to move there.
