Canadian marrying American

Post Sun Jul 31, 2011 4:21 pm

Hi everyone, have a few typical and unusual questions I would appreciate help with. I'm am a canadian and intend on marrying an American. First marriage for both, clean records. I am in Windsor, Ontario and he is just outside Detroit. I have a job I love and is lucrative financially as well. As it makes more sense for me to live there , I plan on doing so and commuting for work. We are wondering what the steps are to best accommodate this- is my understanding correct in that the best way for us to do this is to marry then apply for I-30 and cr from there? As I want to keep this job we cannot do the fiancé visa since I wouldn't be allowed to return to the states if I left. Since we are a border city I assume this is a common scenario. I gathered that as long as I can show proof ( my mortgage, pay stubs, bills etc (ongoing) ) that I have a good chance of being able to visit him for a night or two while paperwork is pending. Anyone have experience with this? If they know I don't plan to stay in states And show proof of ties to Windsor should I anticipant problems? Also, I will be renting a room (after paperwork is finished and my house sold) in windsor . Am I able to hold both a Michigan and Ontario drivers license( I need to keep Ontario dl for my job). Also, if anyone has been in a similar situation is my ohip valid since I will still be in Windsor half the year with a secondary address for such? Appreciate any insight, this is an overwhelming process as everyone knows. We were going to see an attorney for a free consult soon but will do the visa applications ourselves. Any idea on processing times? Thanks again for any help!! :)

Everything u need for FREE is on Visajourney! There are Cdns on VJ that reside in the USA, but work in Canada, 1 on VJ is even a Cdn Border official.

But the a Greencard, one is expected to reside in the USA for a certain amount of time, and if you are not meeting those requirements, you can loose it. As well as a Green card holder, your a resident of the USA---and a NON-Resident of Canada, and being a non-resident of Canada, means no health care coverage. I could be wrong about that, but I recall 1 of them saying they are no longer entitled to CDN health care as they are no longer a Cdn Resident. I'm sure if u post in the Canada section on VJ, or the CR-1 forum, you may get more responses.

Many of us visted the USA while the process was ongoing. Most have no problems, but some do! Always have proof of ties to Canada when you VISIT the USA. Saying"live" isn't a good thing, lol But it al boils down to 1 thing--the POE officer!! I visited DC monthly with no problems.

All CR-1 for ALL of Canada goto Montreal for the interview and Mtl is slow!! One is looking around 1 year from start to finish!! Sometime faster, sometimes slower!! There is a timeline on the Cdn forum!!

I dont believe you can have 2 Drivers licenses, I know in Virginia they took my Nova Scotia license! But each State has their own rules.

I highly recommend you read the GUIDES on the CR-1 forum--there are step by step guides on how to file everything and goes over the process step by step!! Everything u need is there!! You may find the lawyer is clueless, lol Some of the process has changed, so they may not be up to date. For example DHL delivers the Passport to you in Canada.

We hired a lawyer -----had NOT found VJ----waste of $$$$$$$$$$$$$$. Sure she was nice, but really all she was, was a $$$$$ proof reader!! Youstil have to gather the required info, long form birth certificate (has ur birth parents on the birth cert) marriage cert, criminal record check, etc etc. But if its a free consult, why not. But read over VJ!!! Its a friendly bunch in the Cdn section
