Canadian Pensioner permanent resident in the USA

Post Wed Aug 10, 2011 9:06 am

I am sure this question has been asked and answered but I cannot find a direct example similar to mine. I am a legal permanent resident in North Carolina and receive a Canadian Employer Pension. I still have 3 years before I can claim Canada Pension. I am also going to start a part-time job in the USA to help with Medical expenses cause my wife has Hepatitis C. I already wrote to Rev Can and am considered a non resident for tax. Now I need to figure out how to file. Rev Can says I am paying 25 % minimum tax in Canada now but that could change due to tax treaty with the USA. How to I go about filing my taxes without this costing me a boat load of money. A tax accountant here in NC wants a thousand dollars to do the filing. Please help with Ideas and resources I can use. Thanks

Your pension should only have been taxed 15% by treaty from the moment you moved to US and became Cdn non-resident. If your comapny has been withholding more than this, you should be applying for a refund using form NR-7-R. Your comapny MUST reduce the amount they are withholding to a flat 15%.

You did need to file a departure return when you left (when was that?).

I answer these Q's in more detail at forums.serbinski.com

I left Canada January of this year and wrote to Revenue Canada in February, I just a reply from them in July advising that I was considered a non resident as of January 16th. Dont know anything about this NR-7-R

Well, if your pension is being withheld incorrectly, you will need to know about it.

have you contacted your pension manager to tell them you live in US yet? They will correctly withhold only if you tell them.
