If you were arrested you were arrested and you should answer yes to that question. if they ask if you have been convicted, you should answer charges are pending.

This will likely make you inadmissable to the US I think.

A DUI charge is very serious. Driving under the influence is a severe crime in every state. The consequences of a conviction are life-altering.DUI (Driving Under Influence ) is a serious criminal offence that result the suspension of driving license.
. If you have been charged with a DUI you should seek legal help at once from DUI lawyers.

I'm a Canadian who will be seeking TN status to work for US company. I have a 13 year-old DUI charge from Canada, and very worried about being turned away.

My most important question is whether or not I have a chance of being admitted if I only show as many court documents as I can (showing that I fulfilled all requirements of the violation, got reinstated), or is some sort of US visa waiver mandatory.

I should mention that I am currently in the US on a J-1 visa, travel back and forth every year and have never had a problem. Then again, I've never been asked about any criminal charges.

Many thanks.

lucky for you the youth record doesn't carry over to the adult record in canada
