CANADIAN TO MARRY AMERICAN IN U.S.???

Hello!
I'm from NY and my fiancée is from Canada. Are we allowed to get married in NY? I'm planning on moving to Canada (I'm currently here, but have to go back to NY in 2 weeks due to refusal of extension of stay ) We're having a hell of a time with Immigration and apparently it will make things less complicated if we are married. We don't have time to marry in Canada, so I was wondering if Canadian Immigration recognizes marriages that were performed in the U.S.???
Any insight or info would be greatly appreciated!!! :P

Of course they recognize them.

However, one thing to watch for though is whether US immigration will allow your fiancee to enter US -- even just for the time it take to marry.

The fact that you are returning to live in US, will make it seem (to US the border guys) that your fiancee will be moving there with you. Border doesn't take kindly to fiancees and spouses crossing into US without a properly obtained consular 'K' visa.

Thank you for your reply... My fiancee will have pay stubs from work, bank account receipts etc...with him to show he's returning to Canada to live. He is going to sponsor me to live there asap. We were originally going to get married in Canada, but because my extension was denied we won't have time to marry before I have to leave. He was going to sponsor me as his common law ( we've lived together for over a year and a half ) but an Immigration officer told me that because I'm technically "out of status", only the first six months we lived together counts so we're really not common law... ugh. I'm hearing that things will go much smoother if we are married. I'm waiting on a call back from a lawyer hoping he'll clear up all of the confusion. I get a different story from every Immigration officer I speak to. They all have different versions of what I "should do", what I "have to do" and what's legal or not. It's all very confusing and extremely frustrating!!!

As I said, your problems, once you go back to US, are HIS being able to enter US. You need to nail that down.

Hello,
I am Canadian citizen (female) about to marry a US citizen and have been travelling across the border visiting my fiance for the last 3 years , once or twice a month and staying weekends or up to a week most times.Never once been seriously questioned,harassed,asked to step out vehicle Nadda.(inform officer I am visiting bf everytime!)

Okay, so I have searched the internet high and low to find Canadians who were denied or banned from the US for entering at the border as a visitor with plans of getting married to American, and then staying and filing AOS as spouse of an American. Seems most people get through the greencard interview regardless, if the marriage is legit an there are no other issues, that is.

It appears to me that most Canadians who have been going back and forward to the USA to visit a boyfriend/fiance/spouse, end up AOS successfully since their marriage ends up being a legitimate marriage. Seems that INS focuses more on if you overstayed, or have commited marriage fraud.

Yeah Yeah Yeah people keep talking about visa fraud because of your intents to stay in USA, you need to stay in Canada and file K1, Cr1 and wait, but I have not seen one person say they have been rejected for not doing such.

I am looking for feedback from others who took this route... either was banned/rejected and had to move back to Canada OR who completed this method successfully within the last 6 Months preferbly.
