Canadian wanting to become a Farmer

Post Wed Aug 26, 2009 8:50 pm

Hi,

I am a Canadian citizen living in Canada. I Have purchased some120 acres of Farm land and would like information or advice on any ways of obtaining permanent resident and to be able to live there permanently, legally without having to go back and forth 6 months at the time. I would like to know what type of visa is availableto apply for in order to be self employed in US and farm on my land. I'am not rich so investment visa won't do, My wife currently would not think to kindly of me by planning on marrying an American Citizen just to get into The States, I am planning to build my home there and show the government that I am self employed and running my own farming business, could that help me obtain permanent residency somehow?

Are there any Visa options available to me for this type of business venture ?
I currently do not hold any post secondary degrees.

Thank you for any advice or help offered

E-2 treaty investor - this is a non-immigrant category and requires a "substantial investment" but this isn't like EB-5 which requires a million dollars, "substantial investment" is subjective when it comes to E-2 and you can get them with fairly low investments, I know a guy who started an interior decorator business who got one: http://travel.state.gov/visa/temp/types/types_1273.html

Really you need help from an immigration consultant who has done them before because each application is unique.

With an agricultural business I have a feeling the chances of getting it are going to be somewhat marginal because it has to be "highly skilled" and that boils down to what you're doing with the farm.

If you get it, E-2 is valid for two years and can be renewed indefinitely, your spouse can get work authorization, however bear in mind if you have children it'll be a good idea if they're born in the US otherwise they have no status when they grow up.

I just dealt with a gentlemen who has an E visa for his farm in the USA. Don't risk being barred from the USA. Apply for the Visa. Steven has given you your only options. There is no easy way.
