Canadian wanting to move to USA for 3 months

Post Mon Feb 09, 2009 3:58 pm

Here is my situation:
My boyfriend and I are both Canadians. He is living in the states right now working under a H1-B visa. Anyways, I was just wondering if anyone has any pointers for when I cross the border? i know telling the truth is the best option but what about papers and stuff to prove my boyfriend can support me or I can support myself...Do you think I will have alot of problems just going for 3 months?

Canadians are allowe to visit for up to 6 months per year, so technically 3 months shouldn't be an issue.

Have proof of ties to Canada with you, such as a job that says you're on approved vacation leave, copy of a rental agreement on your home, or school schedule that shows you have to return on a specific date.

Cashy money is always good too, to prove you will be supporting yourself (rather than your boyfriend supporting you) during your stay. Debit cards and credit cards don't count, they like to see that you have some cash.

And a return ticket.

Some ports will insist on seeing a return ticket depending on your method of travel.

I know they will also want to see if I have enough funds to support myself for 3 months...how much do you think they expect for a 3 month stay when all I will be paying is food?
And by return ticket, do you just mean a reason to come home? I have an accepted leave of absence letter from my work, do you think that is enough?

The reason I emphasized return ticket is because I will be crossing by car...also, do you think the border will want to see tax receipts from my boyfriend proving that he can support me?

Probably not. Just make certain you are able to show them a return ticket. If you can show them you are returning to some kind of job in Canada, that could be powerful evidence as well.

They don't want to see that your USC boyfriend can support your trip, that would imply immigrant intent. They want to see that You can support your trip.

No. In fact if you can show you were "co-habiting" in Canada you can stay as long as his H-1B is valid as a B-2 visitor, you just have to renew status every six months by filing an I-539 (or re-enter). They even have the discretion to let you in for up to a year at the POE straight off the bat although it's hard to convince CBP to do that.

The only real requirement is that you demonstrate "non-immigrant intent", which for a B category visitor means you have to maintain residential ties to Canada, i.e. you must have an abode in Canada you have no intention of abandoning.
Steve.
