Canadian Wife of Hockey Player in US

Post Sun Dec 05, 2010 12:08 pm

Hello,
This is my first post on here.
I am the wife of a hockey player in the minor leagues. I am not on a Visa as a dependant of my husband (a P4) because he could be let go at any time. I crossed the border on October 4th, 2010, and according to what I have read about the border, I am allowed to be here until April 4th, 2011.
If I return home at Christmas for 2 weeks, and then head back to the US until the end of January, and then return home in February for 3 weeks, as a total of 5 weeks home, does this extend my stay until May 9th, 2011?
Thanks for any information you can give me!

You should simply enter on P4, that way you have no restrictions on time in US.
Just because his P status may end enytime doesn't mean you shouldn't enter on P as well. P status has no time restrictions.

If he loses hos P status, you will both be retuirning to canada, and then you can re-enter US on B status (like you did now) anytime you want.

But to answer your original question, when you cross the border, previous time spent in US doesn't matter either way: you're entry is judged as to whether yo uare a tourist or not, based on what ties you have in Canada, and what ties you have in US.

The entry on P4 however only depends on spouse. You don't have to prove your Cdn ties.
