I am a Canadian citizen living &#x26;amp; working in US  Can I file a US tax return jointly with my wife living in Canada ?
I have done calculation on turbotax both as filling separately and jointly with my wife. I am getting $9000.00 return if file jointly as against paying additional $2000.00 if filing separately.

Hi there.

First, thanks for the helpful people here. All this stuff is really more complicated than I thought.

I am Canadian and met someone from the US (nothing new here... haha). I originally planned to study in the US (F1 visa I think), but after reading about it, I realized that I wouldn't be able to work.

That was really disappointing for me, not being able to work meant I probably couldn't study there. We'd like to see each other frequently so I thought that maybe I could study in Canada, and with the money I save I could get a passport and visit often.

Since education is so cheap here and so costly in the US (same program in school costs me 5000$CA /year or something like 25 000$ US/year!!), with the money I save I could basically travel there every weekend and still save money. (In reality I would maybe go there 2-3 weekends each month)

Now, just to be sure, wouldn't there be a problem with that? I know as I Canadian I can stay up to 6 month in the US, but would they start asking questions after a while? Or would it be fine since I'm only staying for 2 days and always returning in Canada?

I am a Canadian that arrived to USA in August 2009, I am going to file my taxes in USA and don't know if I should file as a Non-Resident or Dual-status ( I fail Substantial presence test).

I have never worked or filed taxes in Canada as I lived most of my life in Spain. Can I still file dual-status? What do you think is the best option for me?

Hi, I'm planning to enter the US on a TN-visa and was looking into tax implications. One thing I notice is every discussion centers on &#x26;quot;breaking residential ties&#x26;quot; to become a &#x26;quot;factual non-resident&#x26;quot;. This is problematic because it may be a pain and also could hurt with proving you don't plan to stay in the US for good (for a TN at least).

What I'm wondering is why no one uses deemed non-resident instead. In particular, am I understanding something wrong? Here's how I understand deemed non-residency:

According to STARTLINK.cra-arc.gc.ca/tx/nnrsdnts/ndvdls/nnrs-eng.html, if you are a resident of another country according to a tax treaty with Canada, you are declared a deemed non-resident and considered a non-resident (even if you still have residential ties I believe).

According to the IRS (STARTLINK.irs.gov/businesses/small/international/article/0,,id=96352,00.html, you will be a US resident for tax purposes if you meet the substantial presence test, which basically means 31 days during the current year and 183 days in the past 3 years (including current year).

According to the Canada-US tax treaty (STARTLINK.garygauvin.com/WebDocs/Canada-US%20Consolidated%20Tax%20Treaty.pdf), if you're considered a resident of both countries, you basically will be a resident for tax purposes of the one with stronger ties (which if you're on a TN visa, is almost guaranteed to be the USA).

So now consider this situation: You go to the USA in August 2009 on a 3-year TN visa, of course in 2009 you are a resident of Canada for tax purposes and have to do two sets of taxes. Now let's say you work all 2010 in the USA, but haven't broken off enough of your Canadian ties. If I understand the &#x26;quot;deemed non-resident&#x26;quot; clause correctly, for tax purposes you can claim you are not a resident of Canada regardless of ties?

Is there something I'm missing here, because it seems like this is a way smoother method than breaking off ties, yet all the discussions I've seen on here and other sites are about &#x26;quot;factual non-residents&#x26;quot;. Even one thread titled &#x26;quot;deemed non-resident&#x26;quot; actually seemed to be discussing factual non-residents. 

Any comments?

Hi there,

Facts:
- I am a resident permanent from Canada (French Citizen).
- I own an Incorporated Canadian company from Quebec (registred in QC)
- That canadian company will be signing an independant contractor agreement with a NY based company to work for a third party client in the California.
- this agreement is for me to provide Web Consulting services to the US Californian client
- The Canadian / QC company will be paid by the NY based company in Canadian dollars
- I will be mainly working remotely from Canada but will be travelling 4/5 times for meetings/document reviews within the 4 month of contracts
- I do not have any US visa (only the regular visa for tourist when I go to USA as french citizen living in Canada as resident)

Questions
1 - As a resident is there anything I am not allowed to do? Meaning is there any issue with this situation?
2 - Do I need a Working visa from the NY or California company?
3 - What are my obligations in term of Taxes?
4 - Any specific US form I should fill in?

I work for a Canadian engineering consulting firm.  I am an engineering technologist, with a degree in one engineering discipline and a certificate in another.  The Canadian firm pays my wages and benefits, supplies my supervision, and hands my income tax to CRA.  I spend the bulk of my time in Canada, and the bulk of the actual work I do takes place in Canada, wherever the customer is located.  

We have customers and projects in the US.  At times, we need to go to site to review the facilities and collect information.  Then we go home, work up the design, submit it to the client, who then gets the ball rolling to have it built by US contractors.  During construction, we go to site  to make sure it is being built as we designed,  and to commission the new equipment when it is built. Do we need TN status to go to the site in the US to do this work?  

The NAFTA agreement is not too clear.  The various official websites are just as vague.  Actual treatment at the border is variable:  some agents say we need it, others do not.

From the US Embassy site:

 A citizen of a NAFTA country may work in a professional occupation in the U.S. provided that all of these conditions are met:

   1. The profession is recognized under NAFTA.
   2. The alien possesses the specific criteria for that profession.
   3. The prospective position requires someone in that professional capacity.
   4. The alien is going to work for a U.S. employer.

My belief is that since we are not being paid directly by the US client,we are not working for them.

Any other experience out there?

My husband, an American, and I have an appointment with our local USA consulate next week to submit an I-130. I am Canadian.  We both reside in Calgary and he has permanent residency here.

However, I have questions if anyone can help.  

Do I have to have a medical exam if approved and do I have to have an interview if approved?  If so, do I have to have the interview in Montreal?

Hi Everyone,

So happy to see so many canucks helping each other out.

Here's my situation and I hope I can get some of your very valued feedback.

I am Canadian but went to university in the States. Then got a job there for a few years on H1-B before applying for grad school again in the States and graduated with an MBA. I was fortunate to get another job as a Financial Analyst on H1-B soon after, however, after 2 years I was laid off and therefore moved home to Vancouver.

Because of my connections, I was able to find another job in the US again and this time I would like to use the TN visa as an Economist.
I have all my original diplomas and transcripts.  I am working with the company's HR and lawyer on drafting the right wording for the employment letter. 

My questions are below:

1) has anyone had experiences with YVR? Do the officers there tend ot give people a hard time? 

2) Has anyone tried getting the TN visa application and approved by driving to Seattle? if yes what have been your experiences?

3) what information should I put in the employment letter to better my chances of approval?

4) I worry since that I have been working/studying in the US for the past 10 years the officer will come to the conclusion that I am trying to live in the US permanently and deny me right away.  Should I bring any proof ties to canada to help? 

5) any other advice or caution that you see with my situation, please let me know.

I have an offer to work in a US company, yet I&#8217;m not sure how will my taxes be calculated especially that my family are not moving with me and will stay back in Canada, not to mention that the location of my new job in a nearby boarder city will give me the opportunity to spend at least all weekends, holidays and vacation with my family in Canada.  Can any one advise me on how to calculate my taxation and whether I&#8217;ll be subject to taxation twice at full rate?

I received my greencard on Aug 2008. I did not live in the US anytime after that and I only spent 6 days in July 2009 in the US visiting family.
Because of the economic downturn I could not find a job in the US or transfer to a site in the US within my company. I have not filed any taxes in the US since August 2008 as I assumed that since we have a Canada /US tax treaty and I filed my taxes in Canada I did not need to file for the US. Can somebody please advise as to if I need to file and what forms to I need for  yr 2008 and 2009. Can I do it myself or I need a tax professional to handle this-and if so , any recommendation in the GTA area.
I am so overwhelmed with all this technicality that I am considering filing form I-407 ( abandonment of permanent residence) as I do not see myself in the immediate future moving my whole family to the US.
If I do this can I apply again in the future for a Green card and does this affect my travels to the US for holidays. We are Canadian citizens.

We moved to California mid-July last year, my husband started working on TN-1 status (and me and kids had TD status). Since we plan on staying here, as of October 1st last year our status changed, so we now hold H1B and H4 status. 

We do not fulfill substantial presence test for the previous year, but we plan to stay in the States and have to file tax return here, my question is - are we considered nonresident aliens or resident aliens? Does something change in the alien status when you switch from TN-1 to H1B? 

I really want the simplest tax filing option, do not want to complicate further tax returns. Both me and my husband used to work in Canada, if that's important for the decision. I also canceled UCCB (Universal Child Care Benefit) as of July last year, did not want to have problems when filing taxes for 2009.

From what I already read on this forum, we should have two options:

1. File 1040NR and 8840 in the States and T1 in Canada with claiming foreign tax credits on T2209 and T2036.

2. Claim dual status, file prorated T1 in Canada, in the States file 1040NR up to mid-July and prorated 1040 for the rest of the year.

What do I need to do next tax year in the States if I choose option 1 or 2?

I started reading recommended IRS publication 519, but it`s going to take a while, so I was hoping I might get some answers here. Thanks in advance!
