Hi,

I am a Canadian citizen and my wife is us citizen with Canadian permanent residency. We live in Canada. We are exploring how we could go and work a couple of years in the us...
What is the best and easiest option ? 
I am aware of the TN visa but I am programmer so I don't think it can work. We already have a process started with getting me sponsored for permanent us residency (we are at a point were we have the application on hold and call every year to maintain the application still open). But does that make sense to get permanent us residency for 2 years and losing it after... also would my wife lose her canadian permanency ?
Tax wise, I own a place in Canada... how would that work ?

Hi Steve not sure if this is where I go to ask a question but here goes.... moved to the U.S. on TN status... plan to stay about 3 years. Would like to keep my tax status as Canadian - taxes in the U.S. will be more than in Canada so not worried about getting double taxed. What are the U.S. tax implications? what U.S. tax form would I file? 

I am assuming that I would be taxed in the U.S. as a resident is though - basically payroll deductions. is this assumption correct or would I face some additional witholding ?

This illustrates the fallacy of  maintaining OHIP etc, by painstakingly trying to hold on to Cdn tax residency instead of making a a clean break. 

Carrying OHIP coverage while in US (without supplemental insurance) just doesn't cut it.

Let me preface by saying I've done my research, but unfortunately it seems that cases have so many variables it's better to just ask. 

I'm a Permanent Resident, who will be able to apply for Citizenship in roughly October 2010. I am a Canadian citizen, but have since moved to California where I now work. I have a girlfriend who is a Canadian citizen, who wants to move with me sometime next year (say June 2010). She is a high school teacher, with a B.Sc in Biology. The plan is to have her immigrate. 

I've been looking around a lot, but haven't been able to find anything that really applies. Here's a list of possible solutions, let me know what you think, or suggest new ones.

&#x3C;ul&#x3E;&#x3C;li&#x3E;She comes in on a B-2, and can indefinitely extend it due to co-habitation every 6 months for the cost of $300. She can't work (??), but she can live here until I become a citizen and can petition for a K-1 visa (We may become engaged shortly, regardless of immigration). &#x3C;/li&#x3E;&#x3C;li&#x3E;We become engaged and petition for a K-1 as a Permanent Resident (it isn't clear to me if this is possible). She gets to stay legally while the paperwork is being processed (??), then she can live and work here. &#x3C;/li&#x3E;&#x3C;li&#x3E;She gets an H1-B Visa. This is probably not the best option, since it's hard enough to get them anyways. &#x3C;/li&#x3E;&#x3C;li&#x3E;She gets a TN visa as a biologist (anyone know what range of jobs that covers?)&#x3C;/li&#x3E;&#x3C;/ul&#x3E;
The route that seems the most expedient/legal is to have her on a B-2 and renew stays for co-habitation until I am a citizen and can get a K-1. The only problem is that her intent is to immigrate, not visit.  She can spoof intent to remain in Canada (has her entire family there, bank accounts, has lived there her entire life) but I don't want to do anything illegal. And unfortunately TN visas don't apply for high school teachers (which is some mad BS, who wouldn't want a science/math teacher?).

And it doesn't seem like any options (aside from H1-B visa, or a TN visa as a biologist) allow her to work until K-1 time (which sounds like it could be almost 2 years from now). 

So what's the best way to have her stay in the US with intent to immigrate? It's okay if she can't work while she stays, what's important is that she's here. Also, a K-1 visa will allow her to stay indefinitely as well as work?

Hi all, 
After moved down here to the US from Canada with TN-1 visa I got Divorced.
After that, I meet my beautifully girlfriend with her 3 year's old daughter, she is coming back to the US first week of December and  we decided to get marry here ASA she is back. 
Happens that they terminated me (my job) a week ago and I applied I-539 to extend my time (not answer yet) and try to get a new job or/and finish some business here and go back.

On the event of going back, base on the time that Immigration is going to gave me to finish my business here and knowing that she has a European Passport (Spain), Will her be allow to entry Canada with me on my move (truck+car thu the border) and onces I get there, claim her to stay.

Or, send her w/ daughter first to Canada by plane knowing that she is going to get an automatic 6 months Tourist visa and them I will claim them as family.

My main concern is separation while I am sponsoring her

Any info would be greatly appreciated!

I moved down to California about a year ago on a TN visa.  Back in Canada, I have a large RRSP (actually a locked-in retirement account, or LIRA, but it's mostly the same thing) with RBC Direct Investing.  I enjoy doing the trading and managing my self with it.

However, now that I'm down here, I'm severely restricted on the kinds of trades I can make.  It's very frustrating.

About a year ago, there was a thread here where someone mentioned the possibility of appointing a trustee who lives in Canada, who could then make trades in the account without restrictions.

Has anyone here done that?  Any FAQ's, tips and tricks, do's and don't's?  I'm thinking about asking a trusted relative to do this for me, if it's at all possible.

I have been doing significant research on my wife's upcoming pension plan &#x26;quot;rollover&#x26;quot; for lack of a better term. I noticed many posts here stating RRSP withdrawals incur a 25% non-resident Canadian Tax. This is somewhat misleading and may be incorrect for most Canadians living in the US. In many cases only 15% should be withheld.

I would like the experts here to help me confirm some information I found. First some background:
My wife is a Canadian Citizen and permanent resident of the US for 10 years. All ties to Canada have been severed for tax purposes long ago and she will be filing form NR-73 to get non-residence status with CRA.

Her BC Pension is giving her a few options.
1. Locked-in RRSP or LRSP
2. Locked-In LIF or LLIF
3. Lump Sum in Cash

Being a non-resident for tax purposes immediately provides for &#x26;quot;Exceptions to the Locking-In Requirement for Locked-in RRSPs and LIFs&#x26;quot; according to the Financials Institution Commission Website.

If she chooses Option 1, 2 or 3, and withdraws the whole pension then yes, 25% tax applies and US income tax will also apply.

But, if she chooses Option 1 or 2 and receives pension payments then the rate drops to 15%. Can anyone confirm this?

The key is to take payments (currently about 6.5% of the RRSP's Value) instead of a larger lump sum. I think the minimum age to do this in BC is 55. Confirm?

Also, according to one source:
&#x26;quot;Finally, a note about the 15% limit on periodic payments if you end up in most treaty countries. The more recently negotiated or renegotiated treaties usually specify the limit to be the lesser of 15% or the rate that would be payable if the periodic payments were received by a Canadian resident. With the personal credit at ~$10k and other credits (spousal, age, etc.) applying as well, there may be no Canadian tax payable whatsoever on modest amounts.&#x26;quot;

Does this mean the 15% tax could be reduce to 0% assuming the pension payments are below say $10,000? Even for my wife that files no Canadian tax returns??

Any help or confirmations would be greatly appreciated.

Hi all,

I gave this forum a good search, and was unable to determine the below. I hope someone can help.

I am a Canadian and will be visiting my cousin in Missouri City for a month - my first visit to USA. And I have heard that things are much cheaper in the States. So I do plan to buy simple things like clothes and perhaps one or two PS3 games (I'm a student and on a budget).

I know that I have to pay a duty while coming back to Canada if I buy over $750 -- which I won't exceed since I don't have that kind of money.

What I wanna know is can I get tax breaks or tax refunds from stores (WalMart, Target, etc..)? Someone in class mentioned that if I showed my Canadian Driver's License at any US store, then the 7% state tax is exempted?? Or do I have to save receipts and claim it when returning back to Canada??? As cheap as that sounds, I could really use all the tax breaks.  &#x3C;img src="http://www.canuckabroad.com/forums/images/smilies/icon_rolleyes.gif" alt=":roll:" title="Rolling Eyes" /&#x3E; 

Some guide would be much appreciated.

&#x3C;b&#x3E;Repairs to Property Owned in the USA&#x3C;/b&#x3E;

Hi all,

I'm thinking about buying a condo is Las Vegas with hopes of renting it out.  I have heard that as a Canadian I'm not allowed to do any of the upkeep on the place and I have to hire someone to complete the work (e.g. putting in new flooring for example).  Can anyone confirm what I can and can't do to the place?  Can I change a door lock, clean the place up, screw in a light bulb?  I'm really confused.  I tried looking for info on the web and even the IRS but can't find any resources.  Thanks for any advice.

&#x3C;b&#x3E;Urgent - TN Termination - Divorced + Daugther Stay + House&#x3C;/b&#x3E;

Hi there,
I have reading about the 10 days to leave and filling up I-539 to change status to B2, but I do really need help and advise.
I got termination of my job today, and my TN was renewed on April, up to 2012, I have a house that I bought (still paying) and I am going to sign the re-finance on January/10, besides my layer is serving next week my ex-wife (divorced in February/09) with doc. to lower my child support and supposedly I will be taking her to court on January as well, she remarried 2 months ago, and I know that she already went to an appointment with immigration because her new US citizen husband is claiming her. My daughter  got an TD from my side, but I guess that she is including her on her application as well.
Question: Can I file I-539 to change status to B2, meanwhile search for a  job, I may get a job in 2 months and be able to finish house and ex-wife matters and still be able to renew or update status with the new employer ???

I DO REALLY NEED AND ADVICE

I'm hoping that someone can help me.

I will be working as a medical transcriptionist from my home office in canada soon. The majority of companies hiring are mainly US based. I'm under the impression that I will be considered an independent contractor when hired by a US company. What legal and tax obligations do I need to be aware of with both US and Canadian taxation?

I'm Canadian and have been living in AZ for 3 years now and have extended my yearly TN Visa by flying back to Canada and coming back in through a US/Canada border crossing. I have just been offered a new job and wanted to know if it's best i go home and renew while crossing, or has anyone tried to move to a US/Mexico border crossing in AZ??

I was curious if visa/green card applications have a better success rate when going through a lawyer. The green card I want to apply for would cost me 8 thousand through a lawyer so I just wanted to explore other options before going ahead with this.
