CANADIANS WANTING TO MOVE PERMANENTLY TO USA

Post Sat Jan 10, 2009 7:49 pm

Hi, I am a Pharmacy Technician from Canada and my mom had filed an I-130 Application in order for me to move permanently to USA. The thing is, I have given up my apartment and my job the last time I came to US for a visit and is now working on getting a certification or license to practice pharmacy while in the US waiting for the petition papers.

I am worried that I will encounter difficulties once getting in and out of the US every 6 months. I have relatives in Canada where I can stay for the time-being but I don't have any existing mails that are sent to a Canadian address.

I wanted to do this the right way, so any suggestions would be very much appreciated.

Thank you.

The right way would have been to keep your apartment in Canada and just wait out the process there. Eventually they may get annoyed with your back and forth-ing and deny you entry until you get your visa. You're only allowed 6 months per year really.

Is your mother a US citizen, or a permanent resident? Citizen petitions are currently taking anywhere from about 7 years, and permanent resident petitions are taking about 3 years (no idea why the discrepancy, that's government for ya).

You're not going to be able to move for several YEARS, so giving up your home and your job is not really a bright idea.

Yeah, if you're over 21 I wouldn't hold your breath waiting for a visa number, it will take years and years even if your mom is a US citizen and years more if she's an LPR. I wouldn't base anything you do on the visa number coming up because it's a long way off. Unless of course you've already been waiting years. Even once you get the visa number, the rest of the process takes the best part of a year.

If you're studying in the US the best plan is to get F-1 or maybe M-1 in your situation as it's occupational training, the school should be able to tell you more.

Thank you very much for all your inputs. I've been thinking about going back to Canada and just wait from there. Who knows this idea is way complicated...

If your mom is an LPR and not a citizen, she can file to amend the petition once she gets citizenship which will knock a year or two off the wait. You cannot get married if she is an LPR as there is no category to sponsor married adult children of LPRs, only citizens.
