CDN Parents Working in US

Post Sun Dec 18, 2011 2:10 pm

Looking for some clarification with respect to immigration status for a new family member.

If my wife and I are both Canadian born citizens working in the US on TN VISAs and my wife has our child in the United States, I understand that the child will have both a Canadian citizenship (based on the citizenship of the parents) and a US citizenship based on the fact that he was born in the United States.

Based on what I have read, this should not have any affect on our US status becauase a child must be at least 21 before they can sponsor their parents. What if any changes would be required to the existing TN VISAs that my wife and I hold?

Any clarifications or corrections would be greatly appreciated.

Thanks,

Your child IS both US and Cdn citizen. Period. Any process you go thruogh would merley be to obtain proof of those citizenships.

You are correct that he cannot sponsor you for GC until he is 21. But even if he could, unless and until he/you actually took steps to get your GC, this would not impact TN. In these matters immigrant intent is evidenced by actually his filing an I-130 on your behalf, which he cannot do until he is 21.
