Changing Jobs on TN Visa

Post Fri Sep 02, 2011 11:09 am

ok, so i am changing jobs and currently on TN visa.

I understand i need to apply for a new one at the border like i did the first time.
Can anyone tell me if there is anything different about getting the second one?
And is it any easier than the first time?

Example:
- do i still need to prove ties to canada?
- will my wife and kid need to be there to renew their TD visas or are they still valid?

Obviously, i will bring everything else, resume, offer letter, reference letters, etc.

Thanks

The differences are that (a) you do not need to have any ties in canada, since you are legally living in US on TN, and (b) you can keep the first TN so that you can still work for them if you have to give notice (never quit 1st TN job without securing the second).

Your family's TDs are still god until the expiry date they were first issued. Just get then changed the next time it is convenient for them to cross.

AGN,

Thanks very much for the reply.
Over the weekend I went to apply for the TN and was denied (3 times). Each time it was because my work references weren't sufficient enough. Each agent gave me differing responses.

One of the things that 2 of the agents said, was that they needed my marriage license in order to get the TD visas. I didn't bring it because i didn't think i needed to renew the TD's, but they are saying otherwise. The both said that when i get a new TN visa, i need to get new TDs as well.

So, do you think that I should go next time by myself and just get my TN, then later on get the TD's renewed? My wife is worried that the TD visas will expire with the first TN and she will get booted from the country. She has visions of Immigration officials showing up at our door and taking them away.

Yikes.

First off, you should not have tried three times to get TN without bolstering your petition. You can get in big trouble for successively providing poor petition to different officers. I hope you can get better references THEN go back.

Second, while the officer was technically wrong to say you needed to get new TD's for your dependants... since you went to the trouble of bringing them along, then OF COURSE YOU SHOULD HAVE BEEN READY TO GET NEW TDs AS WELL. Your initial post seemed to imply that you were deciding whther or not to bring family, but if you were, then the convienient next time was RIGHT THEN.

As I said, if the family does not renew the TD at the same time as you get your TN, they will AT SOME POINT BEFORE THEIR TD EXPIRES, need to go to the border and get new TDs. No need to rush or be inconvenienced, but it does need to be done at some point.

Since you are having trouble with your renewal, you should be going by yourself, so you can focus on your TN application. Your description of last weekend could have got you booted out. woorying about TDs when you are at risk of being denied TN permanently shows a lack of understanding what your priorities are -- which is getting TN
